These Terms & Conditions govern the provision of data destruction services by Absolute Data Destruction. By using our services, you agree to the following terms and conditions:
1. Definitions
- Client: The individual or organization that requests data destruction services from Absolute Data Destruction Pte Ltd.
- Service: The process of securely erasing, destroying, or otherwise rendering data irretrievable from data storage devices provided by the Client.
- Certificate of Destruction: A formal document provided by Absolute Data Destruction Pte Ltd that certifies the successful completion of the data destruction process.
2. Services Provided
Absolute Data Destruction Pte Ltd offers a range of data destruction services, including but not limited to:
- Hard Drive Destruction
- Solid-State Drive Destruction
- Mobile Device Destruction
- Magnetic Tape Destruction
- Data Erasure Services
These services may be provided on-site at the Client’s premises or off-site at our secure facilities.
3. Service Requests
The Client agrees to provide all necessary information when requesting services, including:
- Type and quantity of devices to be destroyed or erased.
- Specific data destruction method (physical destruction, data wiping, etc.).
- Location of the service (on-site or off-site).
Absolute Data Destruction Pte Ltd reserves the right to refuse services if the information provided by the Client is incomplete or inaccurate.
4. Data Responsibility
The Client acknowledges that they are responsible for ensuring that all data stored on the devices to be destroyed is either no longer needed or backed up before destruction. Once the destruction service has been completed, data cannot be recovered.
5. Service Execution
- On-Site Services: If on-site destruction services are requested, the Client agrees to provide reasonable access to the premises and necessary power or equipment required for the service.
- Off-Site Services: If off-site services are requested, Absolute Data Destruction will securely transport the devices to our facilities for destruction. The Client will be informed once the service is complete.
6. Certificate of Destruction
Upon completion of the destruction service, Absolute Data Destruction Pte Ltd will provide a Certificate of Destruction, confirming that the data has been irretrievably destroyed. The Client acknowledges that this certificate serves as proof of service completion and compliance with applicable data protection laws.
7. Liability
Absolute Data Destruction Pte Ltd will take all reasonable precautions to ensure the secure destruction of the Client’s data. However, Absolute Data Destruction Pte Ltd is not liable for:
- Any loss or damage to the devices or data before service initiation.
- Failure to destroy data due to errors in the Client’s instructions or inadequate disclosure of relevant information.
- Any indirect or consequential damages arising from the destruction process.
In any event, the liability of Absolute Data Destruction Pte Ltd is limited to the cost of the services provided.
8. Compliance
Absolute Data Destruction Pte Ltd complies with all relevant industry standards and regulatory requirements, including:
- NIST 800-88: National Institute of Standards and Technology guidelines for media sanitization.
- GDPR: General Data Protection Regulation for European data handling.
- HIPAA: Health Insurance Portability and Accountability Act for healthcare data.
- PCI DSS: Payment Card Industry Data Security Standard for payment information. The Client is responsible for ensuring that their use of the service complies with their own industry-specific regulations.
9. Fees and Payment
Fees for services will be provided in a quote or invoice issued prior to service execution. Payment is due upon receipt of the invoice unless otherwise agreed upon. Late payments may result in delays or suspension of services. Additional charges may apply for:
- Emergency services
- Non-standard destruction methods
- Extended or difficult access for on-site services
10. Cancellations
- On-Site Services: Cancellations for on-site services must be made at least 24 hours in advance. If cancellation occurs within less than 24 hours, the Client may be charged a cancellation fee.
- Off-Site Services: Once devices have been collected and transported to our facility, the service cannot be canceled.
11. Confidentiality
Absolute Data Destruction Pte Ltd will maintain the confidentiality of all Client information and data throughout the destruction process. We will not disclose or share any information related to the Client’s data, devices, or the destruction process except as required by law.
12. Warranties
Absolute Data Destruction Pte Ltd provides no warranty regarding the fitness for purpose of the data destruction services, other than that the destruction or erasure process will render the data irretrievable, subject to the limits of the specific service requested.
13. Force Majeure
Absolute Data Destruction Pte Ltd is not responsible for any delays or failures in service delivery due to events beyond our control, including but not limited to natural disasters, government actions, labor disputes, or technical failures.
14. Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of Singapore. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts in Singapore.
15. Changes to Terms
Absolute Data Destruction Pte Ltd reserves the right to modify these Terms & Conditions at any time. Any changes will be communicated to the Client in writing or via email, and continued use of the services constitutes acceptance of the updated terms.
